Terms of Use

Welcome toMatchMove Games Pte Ltd. (Co. Reg. No. 200902936W) ("we" and "us", as the case may be) provides the Service (as defined below) to you, subject to the following Terms of Service ("TOS"), which may be updated by us in our sole discretion from time to time without notice to you. You agree that your continued use of the Service after such update will constitute your acceptance of this agreement to be bound by the updated TOS. In addition, when using particular MatchMove Games owned or operated services, you and MatchMove Games shall be subject to any posted guidelines or rules applicable to such services, which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into the TOS. In most cases the guidelines and rules are specific to a particular part of the Service and will assist you in applying the TOS to that part, but to the extent of any inconsistency between the TOS and any guideline or rule, the TOS will prevail. MatchMove Games and/or its holding, parent, subsidiary or related companies may also offer other services that are governed by different Terms of Service , in which case the TOS do not apply to such other services if and to the extent expressly excluded by such different Terms of Services.

MatchMove Games provides users with access to a rich collection of resources, including games, entertainment, media, communications tools, forums, shopping services, search services, personalized content and branded programming (the "Service") through its network of properties which may be accessed through any various medium or device now known or hereafter developed , including but not limited to the World Wide Web, mobile telephone or communications services (such as SMS (Short Message Service)), and/or other Internet or telecommunications services or protocols (such as WAP (Wireless Application Protocol)). MatchMove Games offers games, activities, and services including, but not limited to, game downloads, online games, game purchases, e-greeting applications, browser toolbars, game management utilities, contests, chat services, message boards, video streaming, affiliate programs, game review writing, affiliate email and newsletter tools, other assorted affiliate and social networking services, and general game content browsing.

You also understand and agree that the Service may include advertisements and that these advertisements are necessary for MatchMove Games to provide the Service. You also understand and agree that the Service may include certain communications from MatchMove Games, such as service announcements, administrative messages and the MatchMove Games Newsletter, and that these communications are considered part of MatchMove Games membership and you will not be able to opt out of receiving them. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new MatchMove Games properties, shall be subject to the TOS. You understand and agree that the Service is provided "AS-IS" and that MatchMove Games assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Service, and that access may involve third-party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.

Unless expressly stated otherwise, no information presented in the Service or in connection with any products and services forming part of the Service shall be deemed as a binding offer by us or the relevant third party, but may constitute an invitation for you to place an order. In respect of contracts for our or any third party’s products and services which are made available as part of the Service, these shall be deemed concluded when we or the relevant third party have accepted your order for the same or have provided you with the product or service pursuant to your order.

Please be aware that MatchMove Games has created certain areas on the Service that are restricted from general viewing and you must fulfill the specified conditions to access and view such areas.

If you violate our Terms of Service, MatchMove Games may issue you a warning regarding the violation, or, in MatchMove Games’s sole discretion, immediately terminate any and all Accounts that you have established with the company. You acknowledge that MatchMove Games is not required to provide you notice before terminating your account.

The Terms of Service and any posted rules or instructions regarding a particular game, activity, affiliation service, contest, or sweepstakes constitutes the entire agreement between you and MatchMove Games regarding your rights and obligations in your use of any MatchMove Games property. If there is a conflict between the Terms of Service and any other rules or instructions posted on or in a MatchMove Games property, the company will resolve the conflict within its sole discretion.

In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of Singapore or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service’s registration form (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or MatchMove Games has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, MatchMove Games has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). MatchMove Games is concerned about the safety and privacy of all its users, particularly children. However, please remember that the Service is designed to appeal to a broad audience. Accordingly, if you are a parent or legal guardian, it is your responsibility to determine whether any of the Services and/or Content (as defined in Section 8 below) are appropriate for your child. Similarly, if you are a child, please consult with your parent or legal guardian as to whether any of the Services and/or Content is appropriate for you.

Notwithstanding the foregoing, we may provide you with access to some parts of the Service without you registering as a user. In that case, your identification is based on other means of identification that we deem appropriate. In appropriate cases, identification may be based on data identifying your mobile telephone or communications subscription, such as your subscription number or MSISDN (Mobile Service Integrated Services Digital Network) number provided by your network operator. You agree that such information may be collected and disclosed to us and used in accordance with the TOS.

Registration Data and certain other information about you is subject to our Privacy Policy which is incorporated by reference into and made a part of this TOS. By giving or making available the Registration Data and such other information about yourself to us, you agree and acknowledge that we may use or release such information to third parties as specified in the Privacy Policy, and that you give consent to such use or disclosure. You further agree that providing us with your Registration Data and/or using the Service, you expressly request to receive and consent to receiving communications and materials from MatchMove Games from time to time. You understand that through your use of the Service you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to Singapore and/or other countries for storage, processing and use by MatchMove Games and its affiliates.

You will receive a password and account designation upon completing the Service’s registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify MatchMove Games of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. MatchMove Games cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

You may have a MatchMove Games account without paying MatchMove Games to participate in MatchMove Games online games or other activities on the MatchMove Games Website.

MatchMove Games reserves the right to change our fees or billing methods at any time and will provide notice of any such change at least 30 days prior to becoming effective. All changes will be posted on MatchMove Games and you are responsible for reviewing the billing section of MatchMove Games to obtain timely notice of such changes. Your continued use of the company’s offerings after the posting of the changes on MatchMove Games means that you accept such changes. MatchMove Games will not refund any fees that may have accrued to your account before cancellation of your download or subscription, and we will not prorate fees for any subscription. If your use of our properties is subject to use or sales tax, then MatchMove Games may also charge you for any such taxes, in addition to the subscription or other fees published in the billing section of MatchMove Games.

Trial Subscriptions.

For some games and activities, we may offer a free trial subscription. If you accept a free trial subscription, we will begin to bill your account for that game or activity when the free trial subscription expires, unless you cancel your subscription before that time; or if you agree to terms of any other promotion associated with that subscription. You are always responsible for any Internet service provider, telephone, and other connection fees that you may incur when using MatchMove Games, even when we offer a free trial subscription. Trial subscriptions may not be transferred at any time to any other user.

Fees Charged By Third-Party Sites And Vendors.

We may provide links to other Websites. Some of these Websites may charge separate fees, which are not included in any subscription or other fees that you may pay to MatchMove Games. MatchMove Games may also provide access to third-party vendors, who provide content, goods and or services on MatchMove Games or the Internet. Any separate charges or obligations you incur in your dealings with these third parties are your sole responsibility.

"Content" is defined herein as the software, communications, images, sounds, and all the material and information you encounter through MatchMove Games. MatchMove Games, our Members, our affiliates, and our independent content providers provide most of the Content on MatchMove Games. MatchMove Games does not pre-screen all Content. You bear the entire risk of the completeness, accuracy or usefulness of Content found on MatchMove Games.

Strong vulgar language, crude or explicit sexual references, discussions of illegal drugs, and hate speech are always inappropriate Content for MatchMove Games. Content standards may vary depending on where you are on MatchMove Games, the type of game you are playing and the expectations of the community. Some game play and chat rooms may involve use of stronger language than others, including mild expletives. Always use your best judgment in online conduct. If it is inappropriate in the workplace, don’t post it on our message boards or chat rooms.

MatchMove Games representatives may monitor your communications on MatchMove Games. But we cannot monitor all of the Content on MatchMove Games, and we do not attempt to do so. If you encounter something you don’t want to see, you can report it to the game support or complaint email address for the area in which the incident occurred. MatchMove Games does not endorse, approve, or prescreen any Content that you or other users communicate on the Service. MatchMove Games does not assume any responsibility or liability for Content that is generated by Members or other guests on MatchMove Games. We reserve the right to remove Content that is objectionable to us for any reason. This determination is in our sole discretion, and is final. MatchMove Games does not assume any liability for any failure to remove, or any delay in removing Content.

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not MatchMove Games, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. MatchMove Games does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will MatchMove Games or our licensors, suppliers, vendors, parent, holding, subsidiary or related companies, affiliates, officers, agents or employees, as the case may be, be liable in any way for any Content, including, but not limited to, any exposure to offensive, indecent or objectionable Content, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

In addition, You specifically agree to not use the Service to:

1. upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, subversive, hateful, or racially, ethnically or otherwise objectionable or contrary to public interest, public order or national harmony in all relevant jurisdictions.

2. harm minors in any way.

3. impersonate any person or entity, including, but not limited to, a MatchMove Games official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity.

4. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service.

5. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).

6. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.

7. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation, except in those areas (such as shopping) that are designated for such purpose.

8. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

9. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges.

10. interfere with or disrupt the Service or another person’s use of the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.

11. intentionally or unintentionally violate any applicable law, statute, ordinance, regulation, rule or code, including, but not limited to, any regulations, rules, notices, instructions or directives of any regulatory body or authority, governmental agency or national or other securities exchange.

12. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by Singapore, your country or the United States government as a foreign terrorist organization.

13. "stalk" or otherwise harass another.

14. commit any fraudulent or unlawful act, whether in relation to any third party provider of products and services on the Service or otherwise and/or.

15. collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through n above.

16. Create, display, transmit, or obtain materials that poses a threat to or adversely affects the national security of Singapore.

17. Create, display, transmit, or obtain materials that poses a threat to or adversely affects racial harmony in Singapore.

18. Create, display, transmit, or obtain materials that violates intellectual property law.

You may not advertise any goods or services on MatchMove Games. Chain letters and pyramid schemes are expressly prohibited. You may not use any area of MatchMove Games to collect information, including Login names, about MatchMove Games Members, and use of such information to send unsolicited email or for any other purpose is strictly prohibited. You may not exploit MatchMove Games, or any games or services offered on MatchMove Games for any commercial purpose. Any violation of these provisions can subject your MatchMove Games account(s) to immediate termination (or result in revocation of Guest status, if you are a guest) and to further legal action.

The use of machines, computers, scripts, "bots" or any automated system on MatchMove Games is strictly prohibited and may result in criminal liability. You may only play MatchMove Games with one type, version or copy of browsing software application at any one time. MatchMove Games may terminate and permanently disqualify any Members who, in its sole discretion, determines as being in violation of these Terms of Service. All decisions by MatchMove Games are final.

Much of the Content available on MatchMove Games is owned by MatchMove Games or our licensors, and is protected by copyrights, trademarks, and other intellectual property rights. You will not copy or download any Content from MatchMove Games unless we have expressly authorized you to do so in writing.

You must have the legal right to upload any Content to MatchMove Games before you do so in writing. You will not copy, transmit, modify, distribute, show in public or in private, modify or create any derivative works from the Content you find on MatchMove Games, unless MatchMove Games expressly authorizes you to do so in writing. Making unauthorized copies of any Content found on MatchMove Games can lead to the termination of your MatchMove Games account(s) (or revocation of Guest status, if you are a guest) and may subject you to further legal action. Similarly, other content owners may take criminal or civil action against you. In the event legal action is taken against you for your acts and/or omissions in participationg on MatchMove Games, you agree to indemnify and hold harmless MatchMove Games and its subsidiaries, affiliates, related companies, employees, officers, directors and agents.

MatchMove Games may include hyperlinks to Websites operated by parties other than MatchMove Games including advertisers and other content providers. Those sites may collect data or solicit personal information from you. MatchMove Games does not control such Websites, and is not responsible for their content, privacy policies, or for the collection, use or disclosure of any information those sites may collect.

When you subscribe to play certain games you may need to read and agree to a service or membership agreement that is specific to that game, and which may have terms that are slightly different from the ones that are found here. Your subscription to that game, and play of that game, is subject to those specific terms and this Terms of Service. If there are any inconsistencies between the game specific terms and these terms, MatchMove Games will be the final and sole arbiter of any such inconsistencies.

MatchMove Games may require that you download software from MatchMove Games or its licensors onto your computer ("MatchMove Games Software"). MatchMove Games grants to you a non-exclusive, non-transferable, revocable, limited license to use MatchMove Games Software to play games on our Service. You may not sub-license, or charge others to use or access MatchMove Games Software. You may not use MatchMove Games Software for any purpose other than that contained within the license granted to you. You may not translate, reverse-engineer, reverse-compile or decompile, disassemble or make derivative works from MatchMove Games Software. You may not modify MatchMove Games Software or use it in any way not expressly authorized in writing by MatchMove Games. You understand that MatchMove Games’s introduction of various technologies may not be consistent across all platforms and that the performance and some features offered by MatchMove Games may vary depending on your computer and other equipment.

NEITHER MATCHMOVE GAMES NOR ITS LICENSORS ARE LIABLE IN CONNECTION WITH YOUR USE OF THE SOFTWARE FOR ANY DAMAGES (INCLUDING LIABILITY FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES OR DAMAGE TO YOUR COMPUTER HARDWARE OR SOFTWARE), AND THE ENTIRE RISK OF USE (INCLUDING WITHOUT LIMITATION ANY DAMAGE TO YOUR COMPUTER HARDWARE OR SOFTWARE) RESIDES WITH YOU.

You acknowledge that MatchMove Games may or may not pre-screen Content, but that MatchMove Games and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, move or remove any Content that is available via the Service. Without limiting the foregoing, MatchMove Games and its designees shall have the right to remove any Content (whether or not provided by you) that we believe in good faith violates the TOS or that has been alleged to infringe any intellectual property or that is otherwise objectionable in our sole opinion, without being liable to you in any way for any loss or damage arising from such removal. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by MatchMove Games or submitted to MatchMove Games, including without limitation information in MatchMove Games Message Boards and in all other parts of the Service.

You acknowledge, consent and agree that MatchMove Games may in its sole discretion access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to.

• (a) comply with legal process.

• (b) enforce the TOS.

• (c) respond to claims that any Content violates the rights of third parties.

• (d) respond to your requests for customer service; or.

• (e) protect the rights, property or personal safety of MatchMove Games, its users and the public.

You understand that the technical processing and transmission of the Service, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

You understand that the Service and software embodied within the Service may include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by MatchMove Games and/or content providers who provide content to the Service. You may not attempt to override or circumvent any of the usage rules embedded into the Service. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the Service, in whole or in part, is strictly prohibited.

To minimise the risk of infringement on any copyright of the games, MatchMove Games has requested and obtained permission the games from the copyright holders known to us. However, many of the games MatchMove Games is unable to find any copyright information or due to general use on the Internet or available in public domain, this information can no longer be obtained. The legislation around Internet developments and applications is constantly developing, and whatever is/is not allowed is not always obvious and there is room for subjective interpretations. It is therefore possible that, despite our careful and genuine intentions, a copyright holder may still feel that his/her interests are damaged. In such case, we request that you contact us. This can be done via an e-mail to cs@matchmove.com. If your objection is reasonable and comprehensible, the relevant game will immediately be removed.

MATCHMOVE GAMES AND ITS PARENT, HOLDING, SUBSIDIARY AND RELATED COMPANIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY OF THE ABOVE MENTIONED INTELLECTUAL PROPERTY DISPUTES FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF MATCHMOVE GAMES OR ITS LICENSORS, SUPPLIERS, VENDORS, PARENT, HOLDING, SUBSIDIARY OR RELATED COMPANY, AFFILIATE, OFFICER, AGENT OR EMPLOYEE, AS THE CASE MAY BE, HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).

When you register with MatchMove Games, you acknowledge that in using the Services to send electronic communications (including but not limited to email, search queries, sending messages to MatchMove Games Chat or MatchMove Games Groups, uploading photos and files to MatchMove Games Photos or Briefcase, and other Internet activities), you will be causing communications to be sent through MatchMove Games’s computer networks, portions of which are located in one jurisdiction, and other locations in other jurisdictions and portions of which are located in other jurisdictions. As a result, and also as a result of MatchMove Games’s network architecture and business practices and the nature of electronic communications, even communications that seem to be intrastate in nature can result in the transmission of interstate communications regardless of where you are physically located at the time of transmission. Accordingly, by agreeing to this Terms of Service, you acknowledge that use of the service results in interstate data transmissions.

MatchMove Games Messenger, including any web-based versions, will allow you and the people with whom you communicate to save your conversations in your MatchMove Games accounts located on MatchMove Games servers. This means you can access and search your message history from any computer with access to the internet. Whether or not you use this feature, other users may choose to use it to save conversations with you in their account on MatchMove Games too. Your agreement to this TOS constitutes your consent to allow MatchMove Games to store these communications on its servers. From time to time MatchMove Games will send you notices through the MatchMove Games Messenger Service to let you know about important changes to the MatchMove Games Messenger or related Services. Such messages may not be received if you violate this TOS by accessing the Service in an unauthorized manner. Your agreement to this TOS constitutes your agreement that you are deemed to have received any and all notices that would have been delivered had you accessed the Service in an authorized manner.

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the Singapore or the country in which you reside.

MatchMove Games does not claim ownership of Content you submit or make available for inclusion on the Service. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Service, you grant MatchMove Games the following worldwide, royalty-free, transferable and non-exclusive license(s), as applicable.

• (a) With respect to Content you submit or make available for inclusion on publicly accessible areas of MatchMove Games Groups, the license to use, distribute, reproduce, modify, adapt, publish, broadcast, publicly perform and publicly display such Content on the Service solely for the purposes of providing and promoting the specific MatchMove Games Group to which such Content was submitted or made available. This license exists only for as long as you elect to continue to include such Content on the Service and will terminate at the time you remove or MatchMove Games removes such Content from the Service.

• (b) With respect to photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the Service other than MatchMove Games Groups, the license to use, distribute, reproduce, modify, publish, broadcast, adapt, publicly perform and publicly display such Content on the Service solely for the purpose for which such Content was submitted or made available. This license exists only for as long as you elect to continue to include such Content on the Service and will terminate at the time you remove or MatchMove Games removes such Content from the Service.

• (c) With respect to Content other than photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the Service other than MatchMove Games Groups, the perpetual, irrevocable and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, broadcast, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.

• "Publicly accessible" areas of the Service are those areas of the MatchMove Games network of properties that are intended by MatchMove Games to be available to the general public. By way of example, publicly accessible areas of the Service would include MatchMove Games Message Boards and portions of MatchMove Games Groups, Photos and Briefcase that are open to both members and visitors. However, publicly accessible areas of the Service would not include portions of MatchMove Games Groups that are limited to members, MatchMove Games services intended for private communication such as MatchMove Games Mail or MatchMove Games Messenger, or areas off of the MatchMove Games network of properties such as portions of World Wide Web sites that are accessible via hypertext or other links but are not hosted or served by MatchMove Games.

By submitting ideas, suggestions, documents, and/or proposals ("Contributions") to MatchMove Games through its suggestion or feedback webpages, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) MatchMove Games is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) MatchMove Games shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) MatchMove Games may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of MatchMove Games without any obligation of MatchMove Games to you; and (f) you are not entitled to any compensation or reimbursement of any kind from MatchMove Games under any circumstances.

You agree to indemnify and hold MatchMove Games and its parent, holding, subsidiary, affiliated and related companies, officers, agents, employees, partners, suppliers, vendors, co-branders, licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another or your breach of any applicable law.

Statute of Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

14. Transmitting unreasonable quantities of data or messages to persons or groups without their consent or request.

15. Spamming or transmitting unsolicited material to a large number of individual persons and/or discussion lists, newsgroups, or other forums even though the material itself may not otherwise violate these guidelines.

16. Being a continued impediment to other users through mass consumption of computing or network resources after receipt of a request to cease such activity, even if the activity is not otherwise disallowed.

17. Transmitting without permission private information such as grades, medical records, financial data, or any other information that is protected by the Law of the countries where users are residing or where MatchMove Games Properties are located.

18. Attempts to compromise computer and/or network security measures or providing information/instructions for how to do so.

19. Unauthorized, deliberate action which damages or disrupts a computing system or network, alters its normal performance, or causes it to malfunction. This includes intentional attempts to "crash" network systems or programs.

20. Attempts to gain unauthorized access to MatchMove Games.

21. Sharing of secure access credentials, such as passwords or private keys.

22. Attempts to guess, capture, "hack", or decrypt the secure access credentials of other users.

23. Attempts to possess, decrypt, or distribute data to which access has not been authorized.

24. Attempts to elevate system privileges or access without consent.

25. Unauthorized access of internal or external services through the use of stolen, guessed, hacked, copied, or discovered secure access credentials or other private data obtained without consent.

26. The willful or negligent introduction of computer "viruses" or other disruptive/destructive programs into the MatchMove Games network or into external networks.

27. Posting links to similar game sites in replies to topic or new topics shall not be permitted unless the link is being used as a resource for the issue(s) at hand.

28. Links to any sites of an adult nature are not permitted. Banner links are not permitted on the forums at any time. Members that continually post such items will be considered to be a "Spammer" and the account may be permanently terminated without notice.

29. Advertisement links that are used for profit will not be allowed unless pre-approved by MatchMove Games Administration.

30. Links to sites advertising products will not be allowed unless it is in relation to the topic in discussion. All other advertisement links are subject to Moderator/Admin approval.

31. Post threads or to send private messages or emails to other users that advertise or solicit any products, services, funds or donations.

32. All links are subject to Administration approval and can be deleted from the members account without notice.

Possible Actions Taken For Violation

It is important to understand that while MatchMove Games is privately operated, its administrative team and key members are made up of extremely capable individuals. This is said to serve as a warning - we like having fun and sharing information about gaming - do not access this site for the purpose of committing any prohibited activities outlined in the "Policies" section of this AUP. In most cases, violations will merely be edited or deleted. MatchMove Games may, in its sole discretion, with or without notice, suspend or terminate your use of this Site and remove or discard any Content on the Site, for any reason and without limitation if you violate these Policies. Unauthorized Software and Utilities:

Mcash

You can pay for select products in MatchMove Games using Mcash. You can purchase Mcash using any payment method made available to you by MatchMove Games from time to time. The Mcash that you purchased will be credited to your User Account at the time of purchase.

Mcash is a virtual token representing contractual permission from MatchMove Games to access the Service of MatchMove Games. Mcash may be purchased or acquired only from MatchMove Games through means MatchMove Games provides or otherwise expressly authorizes. The Mcash that you purchased or acquired shall be credited to your Account at the time of purchase or award.

MatchMove Games reserves the right to limit or block any request to purchase and/or acquire Mcash for any reason. MatchMove Games may cancel or suspend your acess to Mcash in its sole discretion and without prior notice, if (a) you fail to comply with MatchMove Games terms and conditions; or (b) if MatchMove Games otherwise suspects fraud or misuse of Mcash, or any other unlawful activity associated with an account membership registered to or used by you.

MatchMove Games may change these Terms & Conditions of Mcash at any time by updating them on the MatchMove Games website and you will be bound by any new Terms and Conditions when you access the Service of MatchMove Games. MatchMove Games reserves the right to final interpretation of all Terms and Conditions and in the event of any dispute regarding Mcash, you agree that MatchMove Games’s decision shall be final.

Expiry of Mcash

Your Mcash is valid for 12 months from your last mcash purchase date. The date that we use to calculate the expiry date will be the last date that you purchase mcash. On the end of 12 months, your total mcash balance will expire based on your last purchase date. For example, you purchase 10 mcash in Jan 12 and 20 mcash in Feb 12. Your 30 mcash balance will expire in Feb 13 if they are not used since Feb 12 was your last purchase date.

It also means that if you purchase another 10 mcash in Jan 13, your total 40mcash will expire in Jan 14 since we use the last mcash purchase date to calculate your mcash expiry date.

Transfer of Mcash

Users who have verified their accounts via both mobile SMS and email shall be allowed to transfer an amount of minimum 500 Mcash from their own Accounts to other users’ Accounts. Account verification of the recipient is not required. During the pilot phase of Mcash transfer, transaction fees are waived; however, future transfers may be subject to transaction fees, and MatchMove Games shall determine the rate of transaction fees at its sole discretion.
